Terms of use
The short version. Axial is a free beta training tool. Use it for your own training, keep your account secure, and use your own judgment about what your body can do. It’s provided as is, and it isn’t medical advice.
1. Agreement
By creating an account or using Axial (the Axial app and getaxial.training), you agree to these terms, the privacy policy, the consumer health data privacy policy and the health and safety notice. If you don’t agree, don’t use Axial.
2. Axial is in beta
Axial is a beta product. It may change, contain errors, lose data, or be withdrawn, and we may add, change or remove features at any time. We work to keep your data safe, but we can’t guarantee it. You can export a backup from Profile, then Your data.
3. Your account
You must be at least 18. Give us an accurate email address, keep your password secure, and tell us if you think someone else has used your account. You’re responsible for activity under your account.
4. Your information
You own the information you enter into Axial. You give us permission to store, process and display it so we can run the service for you, and to read it as described in the privacy policy. If you send us feedback, we may use it to improve Axial without owing you anything for it.
5. Using Axial
Axial is for your own personal use. Don’t:
- break the law or anyone’s rights with Axial;
- interfere with or probe the security of the service, or access accounts that aren’t yours;
- copy, scrape or reverse engineer Axial, except where the law allows it;
- upload files or links that contain malware or that you have no right to share.
6. Health and training risks
Axial is a training tool. It isn’t medical advice, and it doesn’t diagnose, treat or prevent any condition. Exercise carries a risk of injury. You decide whether and how to follow any session, and you accept that risk. Read the health and safety notice and talk to a clinician before you start if it applies to you.
7. Other companies’ devices and services
Axial works with files and numbers from devices and services made by other companies. We don’t control them, we’re not affiliated with them, and we’re not responsible for them.
8. Our rights
Axial, its software, name and logo belong to us or our licensors. We give you a limited, revocable, non-transferable right to use the app for your own training. Open-source components remain under their own licenses.
9. Ending your use
You can stop using Axial and delete your account at any time. We may suspend or end your access if you break these terms or put the service or other people at risk. Sections that by their nature should continue, such as 10, 11 and 13, continue after that.
10. No warranty
Axial is provided “as is” and “as available”, without warranties of any kind, including any warranty of merchantability, fitness for a particular purpose or non-infringement. We don’t promise that Axial will be uninterrupted or error-free, or that it will produce any particular result.
11. Limit on liability
To the fullest extent the law allows, Axial won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of Axial. Our total liability for any claim is limited to US$100. Nothing in these terms limits liability that can’t be limited by law.
12. Changes
We may update these terms. We’ll change the date above and, for material changes, tell you in the app or by email. If you keep using Axial after a change takes effect, you accept the new terms.
13. Governing law
These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in North Carolina.
